Planned Parenthood Seeks to Abandon Constitutional Case; Betting on Technicality in Travis County Court

Gov. Rick Perry released the following statement regarding Planned Parenthood's motion to dismiss their constitutional claims and abandon their case in federal court in advance of this morning's Travis County hearing:

"Planned Parenthood has finally acknowledged what we have known from the very beginning - their constitutional challenge is flawed on its face. Venue shopping and courtroom sleight-of-hand in no way helps the women of Texas. We see their stalling tactic for what it is - yet another attempt to unashamedly defy the will of Texas voters and taxpayers."

Background: Planned Parenthood has sought permission to conditionally abandon its case in federal court after the 5th Circuit held that the organization's claims have no merit. While given the opportunity to pursue their flawed case again to the trial court, Planned Parenthood is choosing instead to focus on a technical issue in a Travis County court.
